Notices of intended resolutions, hackney carriage and public hire vehicle licensing

 Please find attached two public notices in accordance with the provisions of the above legislation in relation to resolutions Buckinghamshire Council intends to pass on 27th April 2021.

The resolutions will have the effect of:

  • Confirming Buckinghamshire Council as a single controlled district for licensing purposes in respect of hackney carriage and private hire vehicle operations.
  • Removing the existing hackney carriage zones across Buckinghamshire Council’s area, to be replaced with a single zone.

BUCKINGHAMSHIRE COUNCIL

PART II LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976

NOTICE IS HEREBY GIVEN in accordance with Section 45(3) of the Local Government (Miscellaneous Provisions) Act 1976 (‘the 1976 Act’), that it is the intention of Buckinghamshire Council to pass a resolution on 27th April 2021 that the provisions of Part II of the 1976 Act (other than section 45) shall be adopted and shall apply within the administrative area of Buckinghamshire Council with effect from 6th September 2021.

The predecessor district councils (i.e. Aylesbury Vale, Chiltern, South Bucks and Wycombe) previously resolved to adopt the provisions of Part II of the 1976 Act, which relate to the licensing of hackney carriages and private hire vehicles, drivers and operators. The Council’s intention is to adopt the provisions to take effect across the whole of Buckinghamshire Council’s administrative area. The intended resolution will have the effect of confirming Buckinghamshire Council as a ‘controlled district’ for the purposes of the 1976 Act.

BUCKINGHAMSHIRE COUNCIL

LOCAL GOVERNMENT ACT 1972

ABOLITION OF HACKNEY CARRIAGE ZONES

NOTICE IS HEREBY GIVEN that in accordance with schedule 14 of the Local Government Act 1972, it is the intention of Buckinghamshire Council to pass a resolution on 27th April 2021 to remove all the current hackney carriage zones within the administrative area of Buckinghamshire Council and that all the provisions of the hackney carriage licensing regime be applied across the whole of the administrative area of Buckinghamshire Council with effect from 6th September 2021.
